The Toxic Substance Control Act (TSCA) gives the EPA the authority to take action to address unreasonable risk to public health or the environment from chemicals on the market. The role of TSCA was significantly amended under the Frank R. Lautenberg Chemical Safety for the 21st Century Act to introduce a number of key changes, including:Requiring the EPA to evaluate the safety of existing chemicals in commerce, starting with those most likely to cause risks.Requiring risk-based chemical assessments.Empowering the EPA to require the development of chemical information necessary to support these evaluations.Establishing clear and enforceable deadlines that ensure both timely review of prioritized chemicals and timely action on identified risks.Increasing the public transparency of chemical information by limiting unwarranted claims of confidentiality and allowing for the appropriate sharing of confidential information with states and health and environmental professionals.
